Terms of Service

Some clauses of these terms may be refined during operation. However, Section 3 (Payment, Subscription & Refund) is currently in effect and applies to BuildMate Pro subscription billing.
1. License & Intellectual Property
- BuildMate — closed-source, proprietary software. A holder of a valid subscription/license is granted only a non-exclusive, non-transferable right to use it for personal or internal company purposes.
- Prohibited acts — The following are prohibited: (1) redistribution, rental, or sublicensing of the software; (2) reverse engineering, decompilation, or disassembly — provided that the analysis permitted by Articles 101-4 and 101-5 of the Korean Copyright Act for legitimate interoperability, error correction, security-vulnerability analysis, and the like, together with the use of its results, is not restricted beyond what those laws allow; (3) using KephaLabs' source or binary code or a substantial copy thereof, or acquiring or using KephaLabs' trade secrets by improper means, to develop a competing product or service. — Conversely, independently developing a product by referring to the software's behavior or ideas, or referencing information you lawfully encountered for personal study, research, or evaluation, is not restricted.
- BYOK traffic — BuildMate is a BYOK model in which you call external AI (LLM) APIs directly with your own API key (Section 2). Accordingly, your monitoring, inspection, or retention of your own network traffic, requests, and responses is not restricted by these terms.
- Ownership — All intellectual property in the software, its source/binary code, prompts, tool catalog, UI/design, and documentation belongs to KephaLabs. No right is transferred except the use right expressly granted in these terms.
- Watermark — Certain assets, such as prompts and the tool catalog, may contain watermarks for provenance identification and leak tracing. Removing or forging a watermark and then sharing or distributing the asset is prohibited (acts for personal retention excepted).
- RuleMate — AGPL-3.0. Free to use / modify / redistribute, provided derivative works are also released under AGPL-3.0.
2. BYOK (Bring Your Own Key)
BuildMate operates as a BYOK product — users supply their own Anthropic API key.
- The API key is encrypted with Windows DPAPI on the user's PC; it is never transmitted to Kepha Labs servers.
- API usage costs are paid directly to Anthropic by the user.
- API call inputs / outputs are not collected by Kepha Labs (aggregate metadata is excluded — see privacy policy).
3. Payment, Subscription & Refund
- Product & price — BuildMate Pro is a monthly subscription service priced at ₩5,500/month (VAT included).
- Service period & auto-renewal — BuildMate Pro is an auto-recurring (subscription) service provided in 30-day units. Once you register a card (payment method), ₩5,500 is automatically charged on each period's expiry date to renew for the next 30 days. KephaLabs sends a renewal reminder by registered email about 7 days before each scheduled charge. If a charge fails, we automatically retry over several days; if it keeps failing, auto-billing is stopped and you are notified by email.
- Free trial & auto-conversion — Registering a card grants a 30-day free trial with no charge during the trial. On the trial's end date, the first paid charge (₩5,500) runs automatically, converting you to a paid subscription. KephaLabs sends a notice by registered email about 7 days before the trial ends (auto-conversion). The free trial is offered once per user (email); if a card is registered with an email that already used a free trial, the first charge runs immediately upon registration.
- Cancellation — You may cancel auto-billing at any time, via: (i) the subscription management page (api.kephalabs.com/billing.html) after email verification, (ii) the Revit add-in [Settings] → "BuildMate Pro Subscription" → [Cancel], or (iii) a request to [email protected]. After cancelling, you are not charged from the next cycle, and the already-paid current month remains usable until its expiry.
- Withdrawal (refund) — Within 7 days of payment (inclusive of the payment date), you may withdraw your subscription and receive a full refund under Korea's Act on the Consumer Protection in Electronic Commerce. In particular, your first paid payment (including the first charge after a free trial ends) is refunded in full if requested within 7 days of payment, regardless of whether you used the service during that period. After the 7-day withdrawal period, subscription fees already paid are non-refundable, and you may use the service until the expiry of the paid period.
- Refund process — Refund requests are received at [email protected] (with subscription email and order information) and processed within 3 business days via the same method as the original payment. For credit cards, the actual refund may take additional time depending on the card issuer.
- Payment processing — Payments are securely processed through Korea PortOne Inc. (PortOne) and its partner PG providers.
- Purchase safety (escrow) — In accordance with Korea's Act on the Consumer Protection in Electronic Commerce, KephaLabs is enrolled in KB Kookmin Bank's purchase-safety service (escrow) for consumer protection. Enrollment can be verified at the bottom of this page.
4. Limitation of liability
- This product is provided "AS-IS" and does not warrant fitness for a particular purpose.
- AI-generated plans are executed only after you review and approve them via the Dry-run preview; KephaLabs is not liable for resulting model changes, data loss, or missed operations.
- Medium / High-risk plans display a separate consent modal before execution and run only when you explicitly approve them.
- However, the above limitations do not apply to damage caused by KephaLabs' intent or gross negligence, or by defects in the software itself (bugs, errors, security vulnerabilities). Where KephaLabs is otherwise liable, damages are capped, to the extent permitted by applicable law, at the subscription fees you actually paid in the preceding 12 months (except in cases of intent or gross negligence).
5. Data
Data collection, retention, and your rights are governed by the separate privacy policy.
6. Changes to Service & Terms
- Service changes / suspension — KephaLabs may change BuildMate's features or temporarily suspend the service for technical or operational needs. Except where unavoidable (e.g. security threats or emergency maintenance), we give advance notice of material changes or of long-term suspension/termination — in principle 30 days beforehand — via in-app notice or registered email. If the service is permanently terminated for a paying subscriber, the fee for the undelivered portion of an already-paid period is refunded.
- Changes to terms — These terms may change due to changes in law, improvements to payment/operating policy, or security/technical needs. Material changes such as price, payment method, or limitation of liability are announced at least 30 days before the effective date via in-app notice or registered email, and are also reflected in the "Last updated" date at the top of this page.
- Right to refuse — A user who does not agree to a change may cancel the subscription before the change takes effect.
7. Minors
Minors (under 19) may use the service, but a paid subscription contract must be entered into with the consent of a legal representative. A payment or subscription contract entered into by a minor without the legal representative's consent may be cancelled by the minor or the legal representative; in that case, cancellation and a refund may be requested at [email protected].
8. Termination
If a user materially breaches these terms — for example, the prohibited acts in Section 1 — KephaLabs may, after requesting that the breach be cured and the user fails to do so, terminate the subscription and suspend the service. In that case, a refund of the fee for the remaining period may be restricted in light of the severity of the breach.
9. Governing Law, Jurisdiction & Disputes
- These terms are construed and applied in accordance with the laws of the Republic of Korea.
- Disputes relating to use of the service are first resolved through consultation via [email protected]; where consultation is difficult, the user may apply for dispute mediation to the Korea Consumer Agency (1372, no area code) or the competent Consumer Dispute Mediation Committee.
- If litigation is brought, a user who is a consumer may file suit in the court with jurisdiction over their address or place of residence, in accordance with the Civil Procedure Act and other applicable laws.
10. Interpretation
These terms are based on the Korean-language version; translations, including this English version, are for reference only. In the event of any discrepancy in interpretation, the Korean version prevails.
