Nevic Clash Terms of Use

1. Licence

KephaLabs grants you a free, worldwide, non-exclusive, revocable licence to install and use Nevic Clash, including in commercial projects, on as many computers as you like. There is no fee, no account, no seat count, and no expiry.

You may not resell Nevic Clash, redistribute modified copies, remove or alter its authorship, or reverse-engineer it except where applicable mandatory law expressly permits that despite this clause. You may freely share the download link.

2. What Nevic Clash is — and what it is not

Nevic Clash finds where MEP piping and ductwork pass through walls in a Revit model and determines, geometrically, whether an opening can be created there. Where it can, it creates the opening; where the case is ambiguous, it leaves it on a review list instead. That is the whole of what it claims to do.

• It is not a structural or fire-safety review. Nevic Clash makes no determination about whether cutting a wall is structurally safe, whether it satisfies fire- or sound-rating requirements, or whether it satisfies any building code or regulation in any jurisdiction, and nothing it creates or displays may be presented as such a determination.
• It does not replace your review. It leaves ambiguous cases on a review list precisely because its output is meant to be checked, not trusted blindly.

3. Your responsibility

You remain solely responsible for the correctness of anything you submit, build from, or rely on professionally, and for reviewing what Nevic Clash found and what it created before and after running it. Keeping backups of your models is your responsibility.

4. No warranty

As permitted by applicable law

Nevic Clash is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that it will be error-free, that it will find every interference in a model, that every opening it creates will be correct, or that it will run without interruption.

5. Limitation of liability

To the fullest extent permitted by law, KephaLabs is not liable for any indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost data, or business interruption, arising from your use of or inability to use Nevic Clash. Because Nevic Clash is supplied free of charge, our aggregate liability for direct damages is limited to KRW 0 — or, where a jurisdiction does not permit that, to the minimum amount that jurisdiction allows.

The Software modifies the user's Revit model, including by creating openings. Such changes may be irreversible. The user is responsible for verifying targets and results before running it and for keeping backups. The Company is not liable for the Software's determinations, for any resulting change to a model, or for any consequence thereof. The Software does not replace the judgment of a licensed professional.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded. If you are a consumer, your mandatory statutory rights are unaffected.

6. Donations

You may support development voluntarily. A donation is a gift, not a purchase: it buys no feature, no licence upgrade, no service level, no priority support, and no warranty, because none of those are withheld from anyone in the first place. Donations are handled by a third-party payment provider under its own terms, and are generally non-refundable except where law requires otherwise.

7. Data

Nevic Clash works on your computer and has no diagnostic-sharing or feedback-submission feature, so it transmits nothing. Details are set out in the Nevic Clash Privacy Notice, which forms part of these terms.

8. Third-party software

Nevic Clash is an add-in for Autodesk® Revit®, which you must license separately from Autodesk. KephaLabs is not affiliated with, endorsed by, or sponsored by Autodesk, Inc. Autodesk and Revit are trademarks of Autodesk, Inc.

9. Availability and changes

Nevic Clash is offered free and may be changed, suspended, or discontinued at any time. Copies already installed keep working; we are simply under no obligation to keep publishing updates or to keep the download server online. If these terms change materially, the date at the top of this page changes, and continuing to use Nevic Clash after that means you accept the new terms.

10. Governing law

These terms are governed by the laws of the Republic of Korea, with the Seoul Central District Court as the court of first instance, except where mandatory consumer-protection law in your country of residence gives you the right to bring proceedings locally and to the protection of its rules — which these terms do not take away.
