Nevic Clash for Navisworks Terms of Use

1. Licence

KephaLabs grants you a free, worldwide, non-exclusive, revocable licence to install and use Nevic Clash for Navisworks, including in commercial projects, on as many computers as you like. There is no fee, no account, no seat count, and no expiry.

You may not resell Nevic Clash for Navisworks, redistribute modified copies, remove or alter its authorship, or reverse-engineer it except where applicable mandatory law expressly permits that despite this clause. You may freely share the download link.

2. What Nevic Clash for Navisworks is, and what it is not

Nevic Clash for Navisworks takes the clashes found by Navisworks Clash Detective and builds a PowerPoint deck with pictures and a table for each one. Its bundled tools create one search set for each value of a chosen property, and let you control the section box with numbers or with handles in the view. That is the whole of what it claims to do.

• It is not a clash judgement. Navisworks finds the clashes and sets their distance and status; Nevic Clash for Navisworks copies those values and does not grade clashes or decide how to resolve them. Nothing in the deck may be presented as a structural, fire-safety or MEP review, or as a determination that any building code or regulation in any jurisdiction is satisfied.
• It does not replace your review. Location cells such as level and grid come from the data in the model; where that data is missing or wrong, those cells are empty or wrong too. The deck is meant to be checked, not trusted blindly.

3. Your responsibility

You remain solely responsible for the correctness of anything you submit, build from, or rely on professionally, and for reviewing the deck, the search sets and the section changes Nevic Clash for Navisworks produces. Keeping backups of your models and Navisworks files is your responsibility.

4. No warranty

As permitted by applicable law

Nevic Clash for Navisworks is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that it will be error-free, that every clash Navisworks found will appear in the deck, that every picture and value in the deck will be correct, or that it will run without interruption.

5. Limitation of liability

To the fullest extent permitted by law, KephaLabs is not liable for any indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost data, or business interruption, arising from your use of or inability to use Nevic Clash for Navisworks. Because it is supplied free of charge, our aggregate liability for direct damages is limited to KRW 0 or, where a jurisdiction does not permit that, to the minimum amount that jurisdiction allows.

The Software does not modify the user's source model files. It may add search sets to, and change the section settings of, the file open in Navisworks; those changes remain in that file if the user saves it. The user is responsible for verifying targets and results before running it and for keeping backups. The Company is not liable for the content of decks the Software produces, for any resulting change to a file, or for any consequence thereof. The Software does not replace the judgment of a licensed professional.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded. If you are a consumer, your mandatory statutory rights are unaffected.

6. Donations

You may support development voluntarily. A donation is a gift, not a purchase: it buys no feature, no licence upgrade, no service level, no priority support, and no warranty, because none of those are withheld from anyone in the first place. Donations are handled by a third-party payment provider under its own terms, and are generally non-refundable except where law requires otherwise.

7. Data

Nevic Clash for Navisworks works on your computer and has no diagnostic-sharing or feedback-submission feature, so it transmits nothing. Details are set out in the Nevic Clash for Navisworks Privacy Notice, which forms part of these terms.

8. Third-party software

Nevic Clash for Navisworks is an add-in for Autodesk® Navisworks®, which you must license separately from Autodesk. KephaLabs is not affiliated with, endorsed by, or sponsored by Autodesk, Inc. Autodesk and Navisworks are trademarks of Autodesk, Inc.

9. Availability and changes

Nevic Clash for Navisworks is offered free and may be changed, suspended, or discontinued at any time. Copies already installed keep working; we are simply under no obligation to keep publishing updates or to keep the download server online. If these terms change materially, the date at the top of this page changes, and continuing to use Nevic Clash for Navisworks after that means you accept the new terms.

10. Governing law

These terms are governed by the laws of the Republic of Korea, with the Seoul Central District Court as the court of first instance, except where mandatory consumer-protection law in your country of residence gives you the right to bring proceedings locally and to the protection of its rules, which these terms do not take away.
